Electronic Reserve Guidelines

All material placed on electronic reserve is for the sole purpose of educational use by students. Copyright-protected material satisfying Fair Use guidelines may be placed on reserve for one semester without obtaining permission from the copyright owner. If the material does not fall within fair use guidelines, permission and/or payment of royalty fees must be secured in advance. The library will make every effort to obtain permission and pay reasonable royalty fees; however, there is no guarantee that items submitted can be placed on electronic reserve.

Faculty may request that material be placed on electronic reserve by completing the ERS Request Form, located on the left-hand sidebar link. Return completed forms, along with the material, to Michele Wood at Golden Library.

Access to electronic reserve material is password protected and it is the responsibility of the instructor to distribute passwords to students enrolled in the class. Golden Library will provide passwords to instructors as files are set up. All electronic reserve material will be removed after use or at the end of each semester, whichever occurs first. All copyright-protected material placed on electronic reserve will include a notice of copyright, and full citation.

Abbreviated Fair Use Guidelines

In accordance with fair use provisions (Section 107 of the U.S. Copyright Act), reserve systems may include copyrighted material with the following limitiations:

One article from a single journal issue, a few pages from a book, one or two charts/ graphs or illustrations from the same source, or one poem from a work may be placed on electronic reserve, per semester. Any item(s) selected must constitute only a small portion of the total work.

The same material may not be placed on reserve by the same instructor for the same course taught in consecutive semesters. Material may not become a standard assigned reading for an individual course taught in multiple sections by many instructors. The total amount of material placed on reserve must constitute only a small percentage of the total amount of assigned reading for the course.

Permission from the copyright owner and/or payment of royalty fees must be secured if an assigned reserve reading does not conform to the guidelines listed above. For complete information on copyright guidelines, including fair use, please see the Golden Library Copyright Policy.
