Motor Vehicle Regulations

These regulations are provided to ensure safe, efficient parking for Eastern New Mexico University (the University).

Policy

Students, faculty and staff are expected to be familiar with and abide by these regulations, and New Mexico Criminal and Motor Vehicle Laws, in addition to the University regulations which are in effect on Eastern New Mexico University property 24 hours a day. Strict adherence to all regulations is required to protect pedestrians and vehicles, and to provide access for emergency vehicles.

The University Police Department has jurisdiction to enforce the regulations with the right to remove or impound any vehicle operated or parked in violation of the regulations. The vehicle’s owner will be required to pay towing and storage charges. The University Police chief has discretionary powers to enforce a policy or traffic control on the campus when not specifically covered by these regulations. Students, faculty and staff are expected to be familiar with and abide by these regulations. The fact that a violation notice is not issued to a vehicle that is illegally parked does not mean or imply that the regulation or law is no longer in effect.

The foregoing purposes and policies are implemented by the following Regulations and Procedures.

Administration

These policies, regulations and procedures shall be administered by the vice president for Student Affairs (VPSA), with assistance from the University Police Department.

Parking Fines Appeals Board

An appeals board shall be appointed by the president to make recommendations to the VPSA and to hear appeals of parking citations. The board will be comprised of eight students and two members from each of the faculty, professional and support staffs.

Parking Regulations

  1. Vehicle Registration
    1. All motor vehicles, including motorcycles, must have a valid University parking permit to park on campus at any time. A permanent registration permit is properly displayed when affixed to the lower right corner of the vehicle’s front windshield (passenger side). Motorcycle, motor scooter and motor bike decals will be placed on front sprocket. Permits are self-adhering; taping or otherwise temporarily affixing the permit will result in a citation.
    2. Students, faculty and staff may obtain parking permits at the University Police Department. There is no charge for registering vehicles. This permit is valid from Sept. 1 through Aug. 31 of the following year. The decal authorizes that vehicle to be parked on University property, but it does not guarantee a specific parking place. If a University employee or student has more than one vehicle that might be driven on campus, the additional vehicle should be registered as well.
    3. Bicycles do not require a permit, however, it is recommended that bicycles be registered with the University Police in order to enhance the chance of recovery if the bicycle is stolen. There is no charge for registration of bicycles.
    4. Visitor parking permits and special parking permits shall be issued by the University at no charge. Such permits shall not be issued to persons who are students, faculty, staff or who are otherwise receiving compensation for their work on campus. Visitor permits and special permits shall be limited to the place or places and dates and times written on the permit. Visitors are required to register the motor vehicle that is to be operated on the premises of Eastern New Mexico University. Visitors must obey the traffic and parking regulations as a condition to remain on the premises of Eastern New Mexico University.
    5. Temporary permits may be issued at no charge to persons having a valid University permit. Temporary permits shall have a limit, which shall be stated on the permit. Temporary permits may be obtained at the University Police Department.
  2. Where To Park
    1. Painted Curbs
      1. Red curbs. Do not park—fire lanes (subject to being impounded)
      2. Yellow curbs. Do not park.
      3. Blue curbs. Do not park, except with New Mexico handicap parking permit or a temporary University handicapped permit issued by the office of Services for Students with Disabilities.
      4. White curbs. Do not park—Parking for University maintenance vehicles only.
    2. Parking Lots
      1. General use: All University parking lots are open at all times for parking to students, faculty and staff with valid University parking permits displayed on their vehicle.
      2. Guest and special use: University parking lots are open to guests and temporary permit holders as stated on the permits.
      3. Special events: For special events (e.g. athletic events, theatre events, community events) parking lots may be opened for general use without permits for the duration of any such event.
      4. Curbs and signs: Regulations regarding curb markings and signs are in effect in parking lots.
  3. General Regulations
    1. Registered owners are responsible for proper parking of a vehicle, regardless of who may be operating the vehicle.
    2. Vehicles shall not be washed or repaired anywhere in campus parking areas.
    3. Vehicles shall not be parked on grass, vegetation or University sidewalks.
    4. For curb parking, vehicles must be parked no more than eighteen (18) inches from the curb.
    5. The responsibility for finding a legal parking space rests with the motor vehicle operator. Lack of space is not considered an excuse for violation of any parking regulation.
    6. When parallel parked, the vehicle must be parked facing the same direction as the traffic flow.
    7. Any person who repeatedly violates parking regulations of the University is subject to vehicle booting and/or the University’s holding the violator’s University transcript.
    8. Failure to comply with the regulations may result in loss of driving privileges on campus or vehicle impoundment. The registered owner is responsible for paying all costs and any fines levied and is subject to other disciplinary action by the University.
    9. Eastern New Mexico University assumes no responsibility for damage to a motor vehicle or any loss while it is operated or parked on campus.
  4. Suspension of Privilege to Drive and Park on Campus
    When a permit holder has accumulated three or more parking violations, the University Police Department may prohibit the permit holder from driving or parking on campus for a period of thirty (30) days. At the end of said period he/she will be eligible to apply for reinstatement of all driving privileges. Any person who drives or parks on campus while on suspension may have his/her vehicle impounded.
  5. Regulations for the Use of Motor Bikes, Motorcycles and Motor Scooters on Campus
    1. These vehicles are subject to the same regulations as four-wheeled motor vehicles.
    2. These vehicles may not be parked in entryways, on sidewalks or pedestrian paths, and must not be stored in University buildings.
    3. These vehicles may not be driven on any walkway, road or driveway not authorized for use by a four-wheeled vehicle.
  6. Parking Violations and Fines:

    • Obstructing Walkway or Driveway (Towing Offense): $15
    • Double Parking: $15
    • Parking on Wrong Side of Street (Against the Flow of Traffic): $15
    • Parking in Such a Manner as to Take the Space of Two Vehicles: $15
    • Parking on Grass or Sidewalks: $15
    • Violation of Any Posted Sign: $15
    • Obstruction of Trash Container: $15
    • Obstruction of Crosswalks: $15
    • Parking (All Others) Not Defined: $15
  7. Citations and Payment
    1. University Police Officers and University Police Department student employees are authorized to issue parking citations for violations of University parking regulations.
    2. Any person who receives a parking citation is required to pay the citation at the University Police Department, or by mail to Station 55, no later than 15 days from the date of the citation.
    3. Fines will be doubled if the driver either fails to pay the fine or to file an appeal within 15 days.
    4. Failure to pay the fine will result in banning the vehicle from parking on campus, and will result in a hold being put on student’s records. Faculty and staff will not be allowed to receive a permit the following year until fines are paid. Magistrate Court, located at 42 427 U.S. 70 Portales NM 88130 (575.356.8569), will manage all citations for nonstudent and faculty personnel for collection of fines.
  1. Appeals
    All parking citations may be appealed to the Parking Fines Appeals Board. The appeal tribunal must consist of at least three members of the board; with one of those members being a student. The following procedure must be followed:
    1. The fine must be paid to the University Police Department located at 3rd and South Ave K (575.562.2393).
    2. A Notice of Appeal form may be obtained from the University Police Department. An appointment to meet with the Appeals Board will be made at that time.
    3. Complete and sign the Notice of Appeal form and take it to the meeting of the Parking Fines Appeals Board.
    4. The Parking Fines Appeals Board will meet the first and third Tuesdays of every month at 4 p.m. in the Student Senate Office in the Campus Union Building.
    5. If the board determines that the citation was not properly issued, it will order a reimbursement of the deposit. If the board determines that the citation was properly issued, the deposit shall be forfeited to the University as payment.
    6. The decision of the Parking Fines Appeals Board shall be final.
  2. General Information
    The Eastern New Mexico University Board of Regents has adopted these rules and regulations for the control of vehicles on the Eastern New Mexico University campus to promote the safety and convenience of faculty, staff, students and visitors, and to facilitate the general operation of the University. These regulations shall apply to all property owned and controlled by the University.
